The Certification and Accreditation Administration of China (CNCA) has released implementation guidelines for relevant provisions concerning testing and certification in mainland China, Hong Kong, and Macao.

Implementation Guidelines for Certification and Accreditation Provisions in the "Arrangement between the Mainland and Macao on Establishing Closer Economic and Trade Relations" and the "Agreement on the Basic Realization of Trade in Services Liberalization between the Mainland and Macao in Guangdong"

The implementation guidelines for certification and accreditation provisions in the "Agreement on the Basic Realization of Trade in Services Liberalization between the Mainland and Macao in Guangdong" and its annexes are as follows:

I. Implementation Guidelines Regarding "In the field of voluntary certification, Macao testing institutions with relevant product testing capabilities accredited by Macao SAR government accreditation bodies are permitted to cooperate with Mainland certification bodies to test products produced or processed in Macao or the Mainland"

(I) Scope of Implementation
1. Product Origin: Applicable to the certification of products produced or processed in Macao and the Mainland, and their business activities.

2. Types of Certification: Applicable to all voluntary certifications in the Mainland.

(II) Qualification Requirements for Testing Institutions
Testing institutions within Macao that engage in certification testing business within the scope of implementation should possess corresponding testing capabilities, obtain accreditation in the relevant field from Macao SAR government accreditation bodies, and have their continued compliance confirmed by Macao SAR government accreditation bodies through surveillance review. Where the certification system imposes special requirements on the qualifications of testing organizations, in addition to accreditation, the testing organization must be confirmed by an accreditation body of the Macao SAR government to meet the aforementioned special requirements.

For testing organizations that are confirmed to no longer meet the requirements or voluntarily relinquish their accreditation, the Macao SAR government accreditation body should report the relevant information to the Certification and Accreditation Administration of China (CNCA).

(III) Implementation Procedures

1. Macao testing organizations that have obtained accreditation from a Macao SAR government accreditation body and intend to undertake certification testing business may contact qualified certification bodies in mainland China regarding relevant testing business and express their intention to cooperate. Contact information and business scope of mainland certification bodies can be found on the CNCA website (www.cnca.gov.cn).

2. In accordance with the relevant basic certification standards and certification implementation rules, the testing organization shall establish a commissioning relationship with the relevant mainland certification body and undertake certification testing business within the agreed scope. After the commissioning relationship is established, the certification body shall submit the commissioning cooperation agreement to the CNCA for record-keeping. The CNCA shall publish a list of Macao testing organizations that have signed cooperation agreements with certification bodies on its official website. 3. For Macao testing institutions that are reported by Macao SAR government accreditation bodies to the Certification and Accreditation Administration of the People's Republic of China (CNCA) as no longer meeting the requirements, the CNCA will inform the relevant certification bodies, which will then adjust their cooperation with the testing institutions and file the adjustment results with the CNCA. The CNCA will publish the list of adjusted institutions on its official website.

4. If mainland certification supervision and management departments discover that Macao testing institutions have violated relevant certification and accreditation laws, regulations, or implementation rules in undertaking certification and testing business, they should report the relevant situation to the CNCA, which will then notify the relevant competent department of the Macao SAR government.

II. Implementation Guidelines Regarding "In the field of Compulsory Product Certification (CCC), Macao testing institutions accredited by Macao SAR government accreditation bodies and possessing relevant product testing capabilities under the China Compulsory Product Certification System are permitted to cooperate with designated mainland institutions to undertake CCC testing tasks for audio-visual equipment products designed and finalized in Macao but processed or manufactured in Guangdong Province."

(I) Scope of Implementation

1. Product Scope The pilot product scope includes audio-visual equipment products listed in the CCC catalog. 2. Product Origin: Applicable to products designed and finalized in Macau but processed or manufactured in Guangdong Province.

(II) Qualification Requirements for Testing Institutions

Testing institutions within Macau that engage in CCC testing of audio-visual equipment products must be accredited by an accreditation body of the Macau SAR Government and possess the capability to test for CCC-certified audio-visual equipment products.

The accreditation body of the Macau SAR Government shall, in accordance with Article 11 of the "Administrative Measures for Compulsory Product Certification Bodies, Inspection Bodies and Laboratories" (Order No. 65 of the State Administration for Quality Supervision, Inspection and Quarantine), the "Implementation Rules for CCC Certification of Audio-Visual Products" (CNCA-C08-01:2014), and the "Application Instructions for Accreditation Criteria for Testing and Calibration Laboratories in the Field of Electrical Testing" (CNAS-CL11:2006), confirm whether Macau testing institutions possess the capability to test for CCC-certified audio-visual equipment products, and issue accreditation documents to qualified laboratories. For laboratories that have been confirmed as qualified, the accreditation body of the Macau SAR Government will conduct a surveillance review annually to confirm their continued compliance. For Macao testing laboratories found by Macao SAR government accreditation bodies to be unable to continuously meet requirements during surveillance reviews, the Macao SAR government accreditation bodies will promptly notify the Certification and Accreditation Administration of China (CNCA).

(III) Implementation Procedures

1. Macao testing institutions with relevant qualifications and an intention to undertake CCC audio-visual equipment product testing business may contact designated mainland CCC audio-visual equipment product certification bodies to discuss relevant testing business and express their cooperation intentions. Contact information and business scope of designated mainland certification bodies can be found on the CNCA website (www.cnca.gov.cn).

2. In accordance with the certification implementation rules, testing institutions and designated mainland certification bodies reach a cooperation intention and establish a commission relationship to undertake certification testing business within the agreed scope. The designated certification body will submit the commission cooperation agreement to the CNCA for approval. The agreement can only be signed and take effect after approval by the CNCA (Note: the approval content does not involve the accreditation of the testing laboratory). The CCC designated certification body will submit the signed cooperation agreement to the CNCA for record. The Certification and Accreditation Administration of China (CNCA) publishes a list of Macao testing institutions that have signed cooperation agreements with CCC-designated certification bodies for audio-visual equipment products on its official website, and informs the Guangdong Provincial Bureau of Quality and Technical Supervision and the Guangdong Entry-Exit Inspection and Quarantine Bureau.

3. For Macao testing institutions that are reported by Macao SAR government-accredited bodies to the CNCA as no longer meeting the requirements, the CNCA informs the relevant CCC-designated certification bodies. The CCC-designated certification bodies then adjust their cooperation with the testing institutions and report the adjustments to the CNCA. The CNCA publishes the adjusted list on its official website and informs the Guangdong Provincial Bureau of Quality and Technical Supervision and the Guangdong Entry-Exit Inspection and Quarantine Bureau.

4. If mainland certification supervision and management departments discover that Macao testing institutions have violated relevant certification and accreditation laws, regulations, and implementation rules in undertaking CCC certification testing business, they should report the relevant situation to the CNCA, which will then notify the relevant Macao SAR government authorities.

III. The Mainland Certification and Supervision Administration is responsible for supervising and managing activities conducted in accordance with this Guideline

The Mainland Certification and Supervision Administration, in accordance with the Agreement on the Basic Realization of Trade in Services Liberalization between the Mainland and Macao in Guangdong and this Guideline, supervises and manages the activities of relevant certification and testing organizations conducted in the Mainland.
